1. General Conditions of Use

The general conditions of use must be accepted by any user wishing to access the site. They constitute the contract between l’Ecole le jet d’ancre and the user. Access to the site by the user signifies acceptance of these general conditions of use. These conditions can be modified at any time; it is therefore advisable to consult them regularly.
In the event of non-acceptance of the general conditions of use stipulated in this contract, the user must renounce access to the services offered by the site and cease using it immediately.
1.1 Définitions
The purpose of this clause is to define the various essential terms of the contract:
- User: this term refers to any person who uses the site or one of the services offered by the site.
- User content: this is the data transmitted by the user while using the site.
- Member: the user becomes a member when identified on the site.
- Username and password: this information is required to identify a user on the site. The username and password allow the user to access services reserved for members of the site. The password is confidential.
1.2 Web Hosting
The site is hosted with the collaboration of two reputable companies, namely RAPIDENET and CLOUDWAYS. RAPIDENET is a Quebec-based company with reliable equipment and quality service. Our site is secure due to its valid RapidSSL private SSL certificate signed by GeoTrust / DigiCert. Additionally, we host our website at CLOUDWAYS, an international online storage company where our site has dedicated resources. When navigating the Internet, your navigator determines if the communication is adequately protected and displays the symbol of a lock. This confirms that communications are secure.
1.3 Responsibility
The journalcreatif.com site is in principle accessible to users 24 hours a day, 7 days a week, except in the event of an interruption, whether scheduled or not, for the purposes of its maintenance or in the event of force majeure. If access to the service is not available, journalcreatif.com undertakes to do its utmost to quickly restore access to the service. journalcreatif.com reserves the right to modify, suspend or stop activity on the site or on any part of it at any time and for any reason whatsoever without having to advise its clients and without engaging its responsibility to its users, members, or any other person. The website journalcreatif.com cannot be held responsible for any damage, whatever its nature, resulting from a rupture in service.
Basic information on the site is accessible free of charge at all times to any user with internet access. All costs incurred by the user to access the service (computer hardware, software, internet connection, etc.) are at their expense.
Content and functionality are provided “as is.” journalcreatif.com strives to provide the most accurate information possible and the sources of information published on the site are believed to be reliable. However, the site cannot be held responsible for omissions, inaccuracies, and deficiencies in updates, whether its own or by third-party partners who provide information. The information provided on the site is for information purposes only. Thus, the user alone assumes full responsibility for use of information and content provided on the site.
Numerous outgoing hypertext links are present on the site; however, the web pages to which these links lead in no way engage the responsibility of journalcreatif.com, which does not control these links, nor the content on the selected pages.
The user is therefore prohibited from engaging the site’s responsibility for the content and resources connected to these outgoing hypertext links.
Non-member users do not have access to the services reserved for members. In order to access these member services, the user must provide a valid username and password. The member user must also pay specific fees for the training offered on this site to access it.
Users are strictly prohibited from any of the following actions, directly or indirectly, by any means whatsoever:
- using our website and its contents for commercial or promotional purposes;
- using our website for illegal purposes;
- compromising the site’s security.
With regard to exchanges on the site, they must be done with respect for our team and others users. L’Ecole le jet d’ancre inc. cannot be held responsible for infractions perpetrated by users of its website.
The site allows its members to post comments and personal work.
In publishing material, the member undertakes to respect the rules of netiquette and the rules of law which are in force.
The site exercises a posteriori moderation on publications and reserves the right to refuse or suppress content without having to justify this to the member.
1.4 Intellectual Property
Brands, logos, photos, graphics, signs, and any other content on the site are subject to copyright protection. Also, and specifically, the NEW CREATIVE JOURNAL method constitutes a trademark. Its French counterpart, JOURNAL CRÉATIF, is a registered trademark legally recognized in Canada and in Europe. Only people who have completed Accompagner et animer avec le Journal Créatif, which is provided by our training centre (L’ÉCOLE LE JET D’ANCRE INC.), and who have obtained their certification, can officially use the CERTIFIÉ EN JOURNAL CREATIF logo, can promote and offer workshops, and provide support using this tool.
The user must request prior written authorization from the site for any reproduction, publication, or copying of various content.
Any content posted by the user is their sole responsibility. The user agrees not to upload any content that may harm the interests of third parties. Any legal action brought about by an injured third party against the site will be borne by the user.
Any user content can be deleted or modified by the site at any time and for any reason. The user does not receive any justification or notification prior to the deletion or modification of user content.
In publishing on our site, the member retains all of his intellectual property rights. However, by publishing content on the site, the member cedes to the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, diffuse, and distribute its publication, directly or by an authorized third party, worldwide and on any platform (digital or physical), for the duration of the intellectual property. Notably, the member assigns the right to use its publication on the internet and on mobile phone networks. To guarantee that this content is not unduly retained, following the access period reserved for members for training, we undertake to erase all messages and images shared by those who participated in the training.
2. General Conditions of Sale
The following general conditions of sale apply to all sales conducted on the journalcreatif.com website, subject to any special conditions stipulated in the product’s presentation.
journalcreatif.com cannot be held responsible for non-execution of the contract due to fortuitous events, force majeure, disruption of, or total or partial strikes including those of postal services and means of transportation and/or communications, flood, fire, acts of terrorism or acts of war. The supplier will not assume any liability for damages incurred as a result of the former, or of business interruption, loss of profit, damages or costs which may arise.
In order to make a purchase and access protected content on the site, “cookies” must be enabled. Consent is implied, under reserve of details included in Section 3 – Privacy Policy – Protection of Privacy and Personal Information.
2.1 Essential characteristics of products and services sold
The journalcreatif.com website sells training courses on the New Creative Journal method.
The customer declares having read and accepted the general conditions of sale prior to placing an order. Validation of your order signifies acceptance of the general conditions of sale.
2.2 Pricing
The price of our products is shown in Canadian dollars or euros and exclude taxes, unless otherwise specified. In the case of sales outside of Canada and paid in euros, excluding the sale of training sessions held in Canada, our services are tax free.
The products which appear on our website are presumed to be available. If you have ordered a product that is not available after the validation of your order, you will be informed as soon as possible, and we will cancel your order. If the amount has already been debited, you will be refunded.
2.3 Orders
To place an order on our site, choose your item and add it to the basket. Verify the contents of your basket.
If you already have a customer account on our site, please identify yourself.
If you do not have a customer account on our site, please create one.
Verify the details of your order and the total amount paid. Correct any errors before validating your purchase.
Choose your method of payment and tick the box next to “I have read and agree to the website terms and conditions”.
Confirm your payment.
An email which confirms your order will be sent to the email address you provided when creating your customer account. Should you not receive this email, please contact us.
The only form of payment accepted on our website is by client card or credit card. When paying online, please indicate the bank card number, its expiration date, and the 3 numbers which appear on the back of the card (Card Verification Value/Code). Online payments are secure.
We require payment in full of your order for most products.
However, for certain products, namely professional training in New Creative Journaling, you may have the option of paying in instalments.
2.4 Refund Policy
You may terminate your purchase at any time within ten (10) days of the date of purchase by contacting journalcreatif.com at admin@journalcreatif.com, provided you have not yet accessed the training content. By registering for a training, and subject to the Quebec Consumers Protection Act, you agree that if you cancel your purchase and request a refund, we may retain 10% of your payment for management fees.

3.2. Data Collection
We collect personal information in several ways, namely when information on our website is accessed, a product is purchased, you subscribe to our newsletter, or you communicate with us by phone or by email.
This personal information varies according to circumstance and can include name, mailing address, postal code, email address, phone number and, if accepted, certain other information used to complete your user profile (either as a trainee or certified person). We retain this information in order to respect the legal obligations and regulations we are subject to, notably in fiscal matters.
The data marked with an asterisk on the site’s contact forms are required to enable us to respond to the member’s request for information.
Certain website functions, such as access to information and personal transactions, require the creation of an account by means of a username and password. If you wish to create an account in order to use these functions, you must provide accurate information and ensure that this information is up to date since, as user, you are responsible for the information you transmit.
You are required to protect the confidentiality of your username and password as well as any other identifier related to accessing our website. Should you fail to respect these General Conditions of Use, L’Ecole le jet d’ancre inc. cannot be held responsible for any damages resulting from these deficiencies.
Certain financial data will be required if you purchase online from our boutique. Credit card payments are handled by Stripe, while bank transfer payment in euros are managed by Wise. We do not have access to these credit card numbers nor do we store them on our server.
We may also use other technology which conforms to the standards of our industry such as pixel labels and invisible pixels in order to expedite use of our website and products (Google Analytics, Meta, Brevo). Pixel labels and invisible pixels are tiny graphic images which are integrated in a certain number of our website pages or our emails, and which allow us to determine whether or not you have engaged in a particular action.
Essentially:
- We gather only and exclusively the information we require to offer our products and services;
- We never communicate, sell or loan out your information to third parties;
- In the event of a breach of information or any incident which may compromise your confidentiality and which may lead to serious repercussions, we will undertake to advise the people concerned.
3.3 Use and Communication of Information
We use and communicate your personal information principally to:
- explore, maintain and improve our website;
- to ensure access to your training sessions;
- to answer your questions and provide support as needed;
- to transmit communications in accordance with the law.
Only administrative employees, training assistants and certain reputable third parties (see Table below) have access to personal information, and only to the information which is strictly necessary to the execution of their duties.
When your personal information is shared with third parties, only the minimum necessary is transferred, and we take reasonable measures to ensure that the rules stipulated in this agreement are enforced, and that these providers offer a sufficient guarantee for the application of appropriate technical and organisational measures.

3.4 Data Conservation
Your personal information is stored and processed in secure locations and on controlled servers in every country where we have installations or in which we solicit third party services. By using our website, you consent to the transfer of information in countries other than your country of residence where the rules surrounding personal privacy may vary from those in your country. However, our privacy practices regarding your personal information are always subject to our present policy and, where required, respect Canadian and Quebec obligations in the matter of personal information as well as those of the general regulations of data protection by providing an adequate level of protection when transferring personal information between the EU or EEE and third countries.
We have installed many physical, administrative and technical measures aimed at protecting the confidentiality and security of personal information which we host: encryption of data during transfer of information, website services according to SSL protocols, regular backups in line with best practices, restriction of access, etc.
Personal information is kept only as long as necessary for the purposes of the present policy.
3.5 Rights regarding personal information
We endeavour to offer a right of opposition to, or removal of, the personal information gathered when you subscribe to our newsletter or when you make a purchase. You can unsubscribe from our emails by clicking the “unsubscribe” link which appears in our mailings. To obtain the personal information content we have retained, or to withdraw from our lists, you can contact us via our contact form, or by communicating directly with the person responsible for personal information (identified in the present policy). A proof of identification is required.
